I have bad credit, so I know I would have a finance charge of atleast 19%. Well the finance manager came out to talk with me and told me that they could finance me and it would cost me 381 a month for 72 months! That would mean that I would be paying 27k for this car that is worth 12k! I told him no way, I did the math before I came and I averaged 11,800 with 21% for 48 months and it came out close to 341. He then told me that he had to pay the bank a fee to finance me?? Is that true? I thought the bank payed the dealer?! So I got really mean and told them forget it. The car is pretty darn bad, but technically reparable. There were some injuries from the people in my vehicle.The car is worth about $15,000 according to Kelley Blue Book (Toyota Yaris, almost a year old with approximately 11,000 miles). The place chosen by the other party's insurance company gave the estimate for fixing the car to be between $10,000 and $11,000. Because that's more than half the value of the car, said insurance company wants to declare it totaled, and (despite it being reparable) wants to pay us the value of the car instead of just paying to repair it, probably because if they don't fix it, they get to auction it for parts (almost all of which are fine, just the frame, doors and seats were messed up it seems) and keep the money. They're also trying to tell us that the car is worth about $2,000 less than it actually is.If we declare the car totaled, they make money off of the parts and we're out several thousand dollars because of what we paid for it plus interest versus the flat-out current value. If we get them to just pay to fix the darn thing, they pay less to us, but they don't get money from the auction. I was planning on selling it before I was in an accident. The kelley blue book value for this car, before the accident was $5,700. Im trying to buy another car and I need to get as much out of this as I can. I dont have full insurance on it so my damage is not covered. It is basically a total loss unless someone is willing to buy. I have seen many of these still on the road so I suppose there is still a possible market for the parts. There is no damage to the engine. In the picture it looks like the hood is damaged but it is just opened. Also the milage is 140,000. Resolved Question: After car repair,... The accident was totally the other persons' fault. Their insurance paid for the repair but I am told that they should also pay for "Depreciation Value". Looking at the Kelley Blue Book car values - my vehicle is now worth less by about $800 since the car is now considered "Good" value and not "Excellent" value as it was before the accident. Should I be compensated further from the guilty parties insurance?


Resolved Question: Is it time to... I have a 2003 Mazda 6, and I owe about 3500.00 on it. Kelley Blue Book value is around 5000.00 trade in. I have a really low monthly payment (170.00/month), and I have about 130k miles on it. Absolutely nothing is wrong with the car, but I am ready for a new one and am wondering if it would be a good move to go ahead and trade it in. I commute to work (about an hour to and from work 14 days out of the month), so I rack up alot of miles and alot of wear/tear, although I take really good car of my cars. It looked to be a DUI. The car isn't his, it's his girlfriends. Anyways my car may be totaled. Can I sue her for inconvenience and monetary losses. Since I now have to purchase a brand new car and open a new 5 loan. My car is worth 16000 on Kelley Blue Book and I still owe 7000 on my totaled car. What are my options. Please help!
